TERMS OF USE & GENERAL TERMS AND CONDITIONS OF SALE (GTC/GTC) — OKSANA BREEDING

1) Identification (publisher / seller)
2) Definitions

  • «" Site "» : the online platform published by Oksana Breeding and its pages.

  • «" User "» : any person browsing the Site.

  • «"Customer / Buyer"» : anyone buying a Product and/or a Animal.

  • «"Products"» : pet accessories/products sold by Oksana Breeding.

  • «" Animal "» : live animal offered for sale/transfer (e.g. puppy).

  • «" Order "» : purchase of Products and/or reservation/sale of an Animal.

  • «" Reservation "» : blocking an animal against payment of a deposit.

3) Purpose – scope

These terms and conditions govern:

  1. use of the Site (Terms of Use) ;

  2. the sale of Products and the sale/transfer of’Animals (Terms and Conditions).

They apply to any order placed via the Site or concluded by direct contact once the Customer has been made aware of them.

4) Acceptance

By browsing the Site and/or placing an order, the User/Customer acknowledges having read and accepted these Terms and Conditions.

A. TERMS OF USE (TOU)

5) Site Access – Availability

The Site is accessible 24/7, except in cases of maintenance, incidents, or force majeure. Oksana Breeding may modify, suspend, or discontinue all or part of the Site at any time.

6) User obligations – permitted use

The User agrees to use the Site fairly and in accordance with the law.

Specifically, it is forbidden to:

  • compromise the security of the Site (intrusion, circumvention, unauthorized testing); ;

  • using robots/scraping without written permission; ;

  • publishing or transmitting content that is illegal, defamatory, hateful, or infringes on the rights of third parties.

7) Intellectual property

The Site and its content (texts, photos, visuals, logos, trademark, charter), databases and technical elements are protected. Any unauthorized reproduction/use is prohibited.

8) Responsibility (Site operation)

Oksana Breeding takes reasonable steps to ensure access to the Site, but does not guarantee uninterrupted access, error-free operation, or suitability for any specific purpose. To the extent permitted by law, Oksana Breeding shall not be liable for indirect damages.

B. GENERAL TERMS AND CONDITIONS OF SALE (GTC) — PRODUCTS

9) Product information – availability

Descriptions and photos are provided for illustrative purposes only (variations may occur depending on the series, colors, and screen). Offers are valid while supplies last.

In case of unavailability after ordering: refund of the unavailable product or offer of an equivalent product.

10) Price

Prices are shown in euros (EUR), including all taxes (TTC), unless otherwise stated.
Delivery costs are shown before order confirmation.

11) Order

The order is considered accepted after:

  • Client validation of information, and

  • confirmation of payment (or validation of received transfer).

Oksana Breeding reserves the right to cancel/refuse an order in case of suspected fraud, non-payment, or abnormal request.

12) Payment (Products & Animals)

The accepted payment methods are:

  • Bank transfer (contact details provided to the Customer when placing the order); ;

  • Stripe (payment by credit card / methods offered by Stripe); ;

  • Species, up to a limit of €1,000.

12.1 Cash payment: limit

Cash payments to a professional are subject to a limit (in particular 1 000 € (when the payer has their tax residence in France).

12.2 Official document

Oksana Breeding can issue a receipt for every transaction.
For any amount over €1,000, A official document is handed over (e.g. Invoice, received, and/or certificate of transfer depending on the nature of the sale).

13) Delivery (Products)

  • Carrier: La Poste

  • Area: France

  • Estimated delivery time: 3 to 7 days (working days) from the date of shipment

  • Fees: according to the current postal service rates, applicable at the time of shipment (format/weight/options).

The customer must check the package upon receipt and report any anomalies (damaged package, missing items, damaged product). within 48 hours à contact@oksanabreeding.com, with supporting photos if necessary.

14) Right of withdrawal (Products)

For the Products For purchases made remotely, the consumer customer has a period of 14 days to exercise their right of withdrawal, under the conditions provided by law.

Procedure :

  1. send a request to legal@oksanabreeding.com within the legal time limit; ;

  2. return the Product according to the terms below.

15) Returns & Refunds (Products)

Return address: Oksana Breeding, 34 chemin des Acacias, 06130 Grasse, France.

Return shipping costs: the return costs are at the Client's expense, unless Oksana Breeding agrees to bear them or Oksana Breeding has failed to inform the consumer of these costs, in accordance with applicable rules.

Required condition: Complete product, unused, in resalable condition, with proof of purchase.

Excluded products (typical examples):

  • customized/made-to-measure products,

  • Products unsealed for hygiene/health protection reasons.,

  • products used/damaged by the Customer.

The refund (if applicable) will be issued after receipt and inspection of the return, in accordance with applicable legal rules.

16) Legal Guarantees (Products)

For the Products, the consumer Client benefits from the applicable legal guarantees (including conformity and hidden defects), according to the law.

C. GENERAL TERMS AND CONDITIONS OF SALE (GTC) — LIVE ANIMALS

17) Booking an Animal – deposit required - cancelation

17.1 Booking deposit (mandatory)

Booking an animal requires necessarily the payment of reservation deposit.
The amount of the deposit is communicated to the Client at the time of booking (quote, written exchange, or order page).

The reservation is now effective uniquely after receipt of the deposit and written confirmation from Oksana Breeding.

Legal clarification: the reservation fee is expressly described as a ’deposit / booking fee“ And does not have the character of a deposit within the meaning of Article 1590 of the Civil Code.

17.2 Cancellation by the Client: no refund

In the event of cancellation by the Client (for whatever reason), No refunds will be issued., including on the booking deposit.

The deposit corresponds to a compensation for immobilization (reservation of the Animal, organization, administrative costs, refusal of other requests, etc.).

17.3 Cancellation by Oksana Breeding

If Oksana Breeding cancels the sale before delivery (e.g., unavailability, veterinary reasons, impossibility of transfer), the sums collected for the reservation are refunded to the Client, except in cases of force majeure or failure by the Client to fulfill its obligations (documents, payment of the balance, failure to appear at the appointment, etc.).

18) Handover/Transfer of Custody

The animal will be handed over by appointment at:
34 Chemin des Acacias, 06130 Grasse, France, or as otherwise agreed.

From the physical delivery (day and time of retrieval), the Animal is placed under the exclusive custody of the Client who assumes full responsibility: transport, food, environment, cohabitation, veterinary follow-up, care decisions.

18 bis) Guarding – delayed recovery – boarding at the Client's request

18.1 Delay in collection after the agreed date
When the Client fails to collect the Animal on the agreed date, for any reason whatsoever, a flat-rate boarding fee of €50 including VAT per calendar day and per animal will be automatically billed from the day after the scheduled collection date until the actual collection of the Animal.

Every day begun is due.

18.2 Security at the Client's request (holidays, travel, temporary inability, personal convenience)
Oksana Breeding may, but is not obligated to, agree to temporarily keep a dog belonging to the Client, particularly in the event of holidays, travel, unavailability or any other request for boarding/sitting.

In this context, the security fees are set at €50 including VAT per calendar day and per dog, unless otherwise agreed in writing beforehand.

Babysitting is only accepted depending on Oksana Breeding's availability and after express agreement.

18.3 Boarding a dog until its sale
At the express request of the Client, Oksana Breeding may agree to keep a dog pending its future sale.
This service is separate from the initial sale or transfer and incurs storage fees. €50 including VAT per calendar day and per dog, unless otherwise agreed in writing.

Oksana Breeding does not guarantee in any way the sale of the dog within a specified period, nor the actual completion of this sale.

18.4 Payment of security fees
The boarding fees are fully payable by the Client and must be settled on first request, or at the latest upon collection of the Animal.

In the event of non-payment, Oksana Breeding reserves the right to suspend the return of the Animal within the limits authorized by law, and/or to initiate any procedure necessary to obtain payment of the sums due.

18.5 Care, food and additional expenses
The boarding fees cover the routine care of the animal.
In addition, any exceptional expenses incurred in the animal's interest, including but not limited to: veterinary care, medication, special food, transportation, medical emergencies, or any unusual expenses required during the boarding period, remain the sole responsibility of the client.

19) Health status – veterinary certificate – certificate of commitment – documents submitted

19.1 Veterinary certificate (less than 3 months old)

When a dog or cat is given away or sold, Oksana Breeding provides a veterinary certificate established by a veterinarian, issued no later than three months before the sale.
The Client acknowledges that the Animal is handed over in good apparent health condition on the date of delivery, in view of the veterinary certificate.

19.2 Certificate of commitment and knowledge (minimum time limit)

The Client acknowledges that the transfer of a pet cannot take place less than 7 days after the delivery of the certificate of commitment and knowledge to the assignee.

19.3 Documents

The Client receives the mandatory documents (certificate/transfer contract, identification, health information as applicable, etc.).

20) Complications after delivery – costs to be borne by the buyer

After delivery, any complication (illness, injury, accident, travel stress, digestive problems, etc.) as well as all associated costs (consultations, tests, treatments, hospitalization, surgery, medications) remain exclusively at the buyer's expense.

Accordingly, Oksana Breeding cannot be held responsible, Financially, no requests for reimbursement, participation, or coverage of medical expenses were made. posterior at the handover, except application of a mandatory legal right or proven fault/fraud.

21) Commercial withdrawal / “return” (Live animals)

The right of withdrawal includes exceptions provisions of the Consumer Code, in particular for the supply of goods liable to deteriorate or expire rapidly.

Given the nature of a live animal, Oksana Breeding does not offer any “commercial returns” nor a reprise of the Animal.

Reserve : This clause does not exclude the application of mandatory legal rights (e.g., redhibitory defects/hidden defects/fraud), when applicable.

22) Specific legal guarantees (Animals)

Since the January 1, 2022, The sale of domestic animals is no longer subject to the provisions of the Consumer Code relating to the legal guarantee of conformity.
The sale of animals is subject to a specific legal regime (particularly regarding defects), and these Terms and Conditions do not have the effect of eliminating the public policy rights enjoyed by the Customer.

25) Consumer mediation (consumer clients)

Every consumer has the right to use a consumer mediator free of charge; the professional must guarantee effective access to a mediation system.

26) Applicable law – jurisdiction

These Terms and Conditions are subject to French law.
In the event of a dispute that cannot be resolved amicably, the competent jurisdictions will be those determined by the applicable rules (and, for consumers, the rules protecting jurisdiction).

27) Modification of the Terms and Conditions of Use/Terms and Conditions of Sale

Oksana Breeding may modify these Terms and Conditions at any time. The applicable version is the one in effect on the date of the order.
